Welcome to SafiPet.

SafiPet is a trade name operated by FurEver Limited (“SafiPet”, “FurEver Limited”, “we”, “us” or “our”). FurEver Limited operates the website located at https://safipet.com/, including its related information, content, features, tools, products and services (collectively, the “Services”).

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you. Purchases made through the SafiPet store are transactions directly between you and FurEver Limited.

These Terms of Service (“Terms”) describe your rights and responsibilities when accessing or using the Services. They incorporate the policies referenced in these Terms, including our:

Please read these Terms carefully. They include important information concerning orders, payments, warranties, limitations of liability and dispute resolution.

By accessing or using the Services, creating an account or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, you should not access or use the Services.

SECTION 1 — ELIGIBILITY, ACCESS AND ACCOUNTS

By using the Services, you confirm that you are at least the age of majority in your place of residence or that you are using the Services under the supervision and with the consent of a parent or legal guardian.

You may be required to provide information such as your name, email address, billing address, shipping address and payment details. You agree that the information you provide is accurate, current and complete and that you have the right to provide it.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. You must notify us promptly if you believe your account has been accessed without authorization.

You may not transfer, sell, assign or license your customer account to another person without our written permission.

We may suspend or restrict access to the Services where reasonably necessary to protect customers, prevent fraud, comply with law, maintain security or enforce these Terms.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to provide accurate product descriptions, specifications, photographs, colors, dimensions, materials, prices and availability information.

However, colors and appearance may vary depending on your screen, device settings, lighting and manufacturing variations. Measurements may also have reasonable tolerances where disclosed on the applicable product page.

Product photographs are for identification and illustration. Customers should review the product description, specifications and size information before purchasing.

We may correct product information, update descriptions, discontinue products or limit available quantities. Any changes will not affect an order that we have already accepted unless the information was clearly erroneous, the product is unavailable, or a change is required by law.

Nothing in this section limits any mandatory consumer rights relating to products that are defective, damaged, incorrectly supplied or materially different from their description.

SECTION 3 — ORDERS AND ACCEPTANCE

Submitting an order constitutes an offer to purchase the products shown in the order.

An automated order acknowledgement does not necessarily mean that we have accepted the order. An order is accepted when we confirm that it has been accepted or begin processing it for fulfilment.

We may decline or cancel an order for legitimate reasons, including:

• Product unavailability;

• Incorrect product or pricing information;

• Payment authorization failure;

• Suspected fraud or unauthorized activity;

• Shipping restrictions;

• Quantity limitations; or

• Legal or regulatory requirements.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

Please review your order carefully before submitting it. If you need to change or cancel an order, contact us promptly at service@safipet.com. We cannot guarantee that changes or cancellations can be made after an order has entered processing or has been shipped.

Products offered through the store are intended for lawful personal or household use unless otherwise expressly agreed in writing.

SECTION 4 — PRICES, TAXES AND PAYMENT

Product prices, discounts and promotions may change without notice. The price applicable to an accepted order is the price displayed at checkout and shown in the order confirmation, subject to the correction of obvious errors.

Unless expressly stated otherwise, product prices may exclude shipping charges, taxes, customs duties, import fees and other charges applicable to the destination.

The full amount payable will be displayed during checkout before you submit the order, except for customs duties, import taxes or similar destination charges collected separately by local authorities or carriers.

You agree to provide current, complete and accurate billing, payment and account information.

By providing a payment method, you confirm that:

• The payment information is accurate;

• You are authorized to use the payment method;

• The payment provider is authorized to charge the order amount; and

• You will pay the displayed price and applicable charges.

Payments are processed through Shopify and authorized payment service providers. We generally do not directly store complete payment card details.

SECTION 5 — SHIPPING AND DELIVERY

Available shipping methods, estimated processing times, estimated transit times, shipping charges and any free-shipping threshold are described in our Shipping Policy and, where applicable, during checkout:

Delivery dates are estimates unless we expressly agree to a guaranteed delivery date.

Delivery may be affected by carrier delays, customs processing, weather, public holidays, address errors, service interruptions and events outside our reasonable control.

We are not responsible for delays solely caused by circumstances outside our reasonable control, but we will provide reasonable assistance when a shipment is delayed, lost or damaged.

Responsibility for loss or damage will transfer in accordance with applicable law. Nothing in these Terms transfers risk to a consumer earlier than permitted by mandatory consumer protection law.

You are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address may be charged to you where permitted by law and where the error was not caused by us.

SECTION 6 — RETURNS, REFUNDS AND CANCELLATIONS

Returns, refund eligibility, return timeframes, return shipping costs, non-returnable products and refund processing times are governed by our Return and Refund Policy:

Our current standard policy provides a 30-day return request period beginning on the date the customer receives the item, subject to the conditions stated in that policy.

We do not charge a restocking fee for approved returns.

For non-quality returns, the customer is generally responsible for return shipping costs. For defective, damaged or incorrect products, we cover the reasonable return shipping cost or provide a prepaid return label, as described in our Return and Refund Policy.

Nothing in these Terms or our Return and Refund Policy limits any mandatory rights or remedies available under applicable consumer law.

SECTION 7 — INTELLECTUAL PROPERTY

The Services and their contents, including text, designs, graphics, photographs, videos, logos, product descriptions, website layout and other materials, are owned by or licensed to FurEver Limited, except for content owned by Shopify or other third parties.

The SafiPet name, logos, designs and related branding are owned by or licensed to FurEver Limited. Shopify’s name, logo and branding belong to Shopify or its licensors.

You may access and use the Services for personal, lawful and non-commercial shopping purposes.

Unless permitted by law or expressly authorized by us in writing, you may not:

• Copy, reproduce, republish or distribute material from the Services;

• Modify or create derivative works from the Services;

• Use our photographs, descriptions, branding or content for commercial purposes;

• Remove copyright, trademark or proprietary notices; or

• Use the Services in a manner that infringes another party’s rights.

No provision of these Terms grants you ownership of or a license to our intellectual property except for the limited right to access and use the Services in accordance with these Terms.

SECTION 8 — OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, applications or features operated by third parties.

Third-party tools may be subject to separate terms and privacy policies. We do not control third-party services and are not responsible for their independent operation, availability or content.

Your use of optional third-party tools is voluntary. You should review and agree to the applicable third-party terms before using them.

New website features or tools introduced through the Services may also be subject to these Terms.

SECTION 9 — THIRD-PARTY LINKS

The Services may contain links to websites, platforms or resources operated by third parties.

We do not control and are not responsible for the accuracy, availability, content, security or privacy practices of third-party websites.

If you visit or purchase from a third-party website, you do so subject to that third party’s terms and policies. Questions or complaints concerning a third-party product or service should be directed to the relevant third party.

The inclusion of a third-party link does not necessarily constitute our endorsement of that party or its services.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

Our store is hosted by Shopify, which provides the ecommerce infrastructure used to deliver the Services.

Products sold through SafiPet are sold by FurEver Limited, not Shopify. FurEver Limited is responsible for its products, product descriptions, orders, fulfilment, customer service, returns and refunds.

Shopify is not the seller of products offered by SafiPet and is not responsible for the sales contract between you and FurEver Limited, except to the extent Shopify separately provides a service directly to you under its own terms.

Nothing in this section excludes liability that cannot legally be excluded.

SECTION 11 — PRIVACY

Our collection, use, disclosure and retention of personal information are described in our Privacy Policy:

Because the Services are hosted by Shopify, Shopify also processes certain personal information relating to your access to and use of the Services.

Information may be transferred to Shopify and other service providers located outside your country of residence where necessary to provide the Services and subject to applicable legal safeguards.

By using the Services, you acknowledge that you have reviewed our Privacy Policy.

SECTION 12 — REVIEWS, FEEDBACK AND USER CONTENT

If you submit a review, rating, photograph, suggestion, comment or other content (“User Content”), you confirm that:

• You created it or have permission to submit it;

• It is accurate and reflects your genuine experience where applicable;

• It does not infringe intellectual property, privacy or other rights;

• It does not contain unlawful, abusive, misleading or malicious material; and

• Any compensation or incentive associated with the submission has been disclosed where required.

You grant FurEver Limited a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format and use User Content for operating, improving and promoting the Services, subject to applicable law.

You retain ownership of your original User Content.

We may moderate or remove User Content where we reasonably believe it violates these Terms, applicable law, platform requirements or another person’s rights.

We are not required to compensate you for unsolicited feedback or suggestions unless agreed in writing.

SECTION 13 — ERRORS, INACCURACIES AND OMISSIONS

Information on the Services may occasionally contain typographical errors, technical errors or omissions relating to product descriptions, pricing, promotions, shipping costs, transit times or availability.

We may correct errors and update information. If a material error affects an order you have already submitted, we will notify you and provide an appropriate option, which may include confirming the corrected order or receiving a refund.

We will not rely on this section to avoid obligations relating to an accepted order or mandatory consumer rights.

SECTION 14 — PROHIBITED USES

You may use the Services only for lawful purposes.

You must not use the Services to:

• Violate applicable laws or regulations;

• Infringe intellectual property, privacy or other legal rights;

• Submit false, fraudulent or misleading information;

• Harass, threaten, abuse or harm another person;

• Upload viruses, malware or harmful code;

• Send spam, phishing messages or unauthorized solicitations;

• Impersonate another person or organization;

• Scrape or access the Services through unauthorized automated methods;

We may suspend or terminate access where we reasonably believe a user has violated these Terms, created a security risk or engaged in unlawful or fraudulent activity.

SECTION 15 — TERMINATION

You may stop using the Services at any time.

We may restrict, suspend or terminate your access if you materially violate these Terms, engage in unlawful activity, threaten the security of the Services or fail to pay an amount properly due.

Termination does not affect rights, obligations or liabilities that arose before termination.

Provisions that by their nature should continue—including intellectual property, privacy, payment obligations, disclaimers, limitations of liability, indemnification and dispute provisions—will survive termination.

SECTION 16 — DISCLAIMER OF WARRANTIES

We aim to provide accurate and reliable Services, but internet-based services may occasionally be unavailable, delayed or affected by technical problems.

To the fullest extent permitted by applicable law, the Services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, completely secure or error-free.

Any product warranties expressly stated on a product page or required by applicable law remain applicable.

Nothing in these Terms excludes or limits warranties, guarantees, rights or remedies that cannot legally be excluded, including mandatory rights relating to defective, damaged, unsafe, incorrectly supplied or misdescribed products.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, FurEver Limited will not be liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable when the contract was formed.

Nothing in these Terms excludes or limits liability for:

• Fraud or fraudulent misrepresentation;

• Death or personal injury caused by negligence where such liability cannot be excluded;

• Willful misconduct or gross negligence where applicable;

• Breach of mandatory consumer rights; or

• Any other liability that cannot lawfully be excluded or limited.

Our liability for a direct claim relating to a purchased product will not be limited below the remedies required by applicable consumer law.

Shopify and other independent third parties are responsible for their own acts and services in accordance with their applicable terms and legal obligations.

SECTION 18 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify FurEver Limited against third-party claims and reasonable costs resulting directly from:

• Your unlawful use of the Services;

• Your material breach of these Terms;

• Your infringement of another person’s rights; or

• User Content that you were not entitled to submit.

This obligation does not apply to losses caused by our negligence, breach of contract, unlawful conduct or failure to comply with applicable law.

Nothing in this section imposes liability on a consumer beyond what is permitted by applicable law.

SECTION 19 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary.

The remaining provisions will continue in effect.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

A delay or failure to enforce a right under these Terms does not waive that right.

These Terms, together with the policies incorporated by reference and any applicable product-specific or promotional terms, constitute the agreement between you and FurEver Limited concerning your use of the Services and purchases made through SafiPet.

If promotional or product-specific terms conflict with these Terms, the more specific terms will apply to the relevant promotion or product, subject to applicable law.

SECTION 21 — ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our written consent, except where applicable law permits otherwise.

We may transfer our rights or obligations in connection with a genuine sale, restructuring or transfer of our business, provided that the transfer does not reduce mandatory consumer protections.

SECTION 22 — GOVERNING LAW AND DISPUTES

These Terms and any separate agreement through which FurEver Limited provides the Services are governed by the laws of Hong Kong, without regard to conflict-of-law principles.

The courts of Hong Kong will have non-exclusive jurisdiction over disputes relating to these Terms or the Services.

If you are a consumer, this section does not deprive you of mandatory protections or the right to bring a claim in another court where such rights are provided by the laws of your place of residence.

SECTION 23 — CHANGES TO THESE TERMS

We may update these Terms to reflect changes to the Services, our business practices, applicable law or operational requirements.

The current version will be published on this page with an updated “Last updated” date.

Where required by applicable law, we will provide additional notice before a material change takes effect.

Changes will not retroactively reduce rights relating to an order accepted before the updated Terms became effective unless required by law or agreed with you.
